Respect others and obey the law
Each User is obliged to use mKontakt.pl in accordance with the law applicable in Poland, these Regulations and the principles of mutual respect. There is no place for hatred, threats, harassment, humiliation, discrimination or vulgar insults to other people.
Illegal content is removed, and the account of a person violating the law or the safety of other Users may be immediately blocked temporarily or permanently.
1. General provisions
- These Regulations define the rules for the provision of electronic services on the mKontakt.pl dating website, including the rules for creating and maintaining an account, publishing content, communicating with other people, moderation and submitting reports and complaints.
- The Website Operator is the entity running mKontakt.pl, hereinafter referred to as the "Operator". The current contact channel is available on the website Contact; contact by e-mail: info@mkontakt.com.
- "User" is a person using the Website, in particular a person who has an account. "Content" is all information added or sent by the User, including descriptions, photos, videos, messages, comments, entries on the forum, blog, groups and guestbook.
- Creating an account and accepting the Regulations means concluding an agreement for the provision of electronic services for an indefinite period. The Regulations are available free of charge before registration and throughout the period of use of the Website.
- The user should also read: Privacy policy, which describes the principles of personal data processing and the use of cookies.
2. Scope of services and technical requirements
- The website allows, in particular, to create a profile, search for profiles, publish photos and descriptions, send messages, run a blog, participate in forums and groups, add comments and use other currently available functions.
- Basic account setup and features listed as free do not require a fee. Some add-ons, points, distinctions or other functions may be subject to payment as described before purchase.
- To use the Website, you need: a device with Internet access, a current browser that supports HTML, CSS, JavaScript and cookies, and an active e-mail address. You are responsible for securing your device and connection.
- The operator may conduct technical work and temporarily limit access to certain functions. If possible, information about the planned longer break will be made available on the Website.
3. User Account
- An account on the Website can only be created by a person who is over 18 years of age. Providing a false date of birth may result in blocking or deleting your account.
- The data provided during registration must be true and current. It is prohibited to impersonate another person, create a profile of a third party without his consent or mislead other Users as to his identity.
- One person may have one active account, unless the Operator agrees to an exception. Accounts that are duplicated, automated, fake or created to bypass a ban may be deleted.
- The User is obliged to protect the password, not to make the account available to other people and to immediately inform the Operator about any suspicion that the account has been taken over. Actions performed on an account are attributed to its owner unless he or she demonstrates unauthorized use.
- You may not sell, transfer or provide access to your account for a fee. It is prohibited to bypass restrictions, blocks, security measures and limits of the Website.
- The User should use the Website personally. Bots, scripts, automatic data downloading, mass sending of messages and other automated activities require the Operator's prior consent.
4. Law, respect and safety
- Each User must use the Website in accordance with the law in force in Poland and the applicable provisions of European Union law. It is prohibited to use the Website to prepare, facilitate, commit or promote an unlawful act.
- Users are obliged to treat others with respect. Differences of opinion are allowed, but personal attacks, persistent aggression, humiliation and intentional provocation of conflicts are not accepted.
- Hate speech and discrimination are prohibited on the Website. You must not attack, dehumanize, humiliate, exclude or incite hostility or violence towards persons or groups, in particular due to nationality, origin, race, skin color, religion or non-denomination, gender, sexual orientation, gender identity, age, disability or health condition.
- Threats, blackmail, persistent harassment, stalking, intimidation, forcing contact, publishing someone else's data or materials without consent, and repeating contact after a clear request to end it are prohibited.
- You must not use the Website for fraud, extorting money or data, inducing risky transfers, false investments, payments outside secure channels or manipulating people in a difficult situation.
5. Prohibited content and conduct
You are prohibited from publishing, transmitting, promoting or sharing Content that:
- is unlawful, incites or facilitates the violation of any law;
- contain threats, incitement to violence, hatred or crime;
- insult, humiliate, defame, persistently ridicule or vulgarly attack another person;
- violates privacy, personal rights, communication secrecy, copyrights, image rights or other rights of third parties;
- disclose without consent the address, telephone number, e-mail address, documents, financial data, intimate information or other data that could expose a person to harm;
- depicts sexual exploitation of minors, sexualizes minors or facilitates contact with them for sexual purposes - such materials result in an immediate block and may be forwarded to the competent authorities;
- contain an intimate image of a person without his or her informed consent, a threat of its publication or materials obtained by fraud;
- promote terrorism, criminal organizations, self-harm or other behavior that directly threatens life and health;
- are spam, unsolicited advertising, an offer from a competitive website, a pyramid scheme, a phishing attempt or contain malicious software;
- is false or intentionally misleading in a way that may cause harm to others;
- violate the rules of a specific part of the Website, e.g. forum, group, gallery or comments.
6. Profiles, photos and content rights
- The profile photo should show the User. You must not publish another person's image without his or her consent, other people's documents, false photographs intended to mislead or materials that infringe copyright.
- Pornographic content, visible intimate nudity and sexual materials inappropriate for the public part of the Website are prohibited in public galleries. Any content intended only for adults may only be included in functions expressly intended for this purpose, in accordance with the law, with the consent of the persons presented and in compliance with the rules of the Website.
- You retain the rights to your Content. By adding Content, you grant the Operator a non-exclusive, free license to the extent necessary to technically store, process, display and make it available as part of the Website's functions. The license expires after deletion of the Content, taking into account backup copies, legal obligations and Content shared with other people.
- Profile content may be publicly visible, available to other Users and - depending on the settings and functions of the Website - indexed by search engines. You should not publish information that should not become public.
- The Operator may delete messages older than 120 days and other technical data or Content when it is necessary for the operation of the Website, in accordance with the retention rules or results from account deletion.
7. Moderation and blocking of accounts
- The Operator may moderate the Content based on reports, its own findings, administrator control and technical mechanisms limiting spam, mass sending of messages and other abuses. Automatic tools can support violation detection, but they can also make errors.
- Depending on the type, scale, effects, repeatability and intentionality of the violation, the Operator may:
- draw attention or give a warning;
- discard, hide, limit visibility or remove Content;
- restrict your ability to post, send messages or use a particular feature;
- temporarily block your account;
- permanently block or delete your account and prevent re-registration.
- Confirmed use of the Website for unlawful activities, threats, harassment, violence, hatred, fraud, sexual exploitation of minors or serious invasion of privacy may result in immediate blocking without prior warning.
- When making decisions, the Operator acts with due diligence, objectively and proportionally, respecting the rights and legitimate interests of all parties. A minor, one-off infringement should, in principle, result in a more lenient measure than serious or repeated abuse.
- If required by regulations or the safety of persons, the Operator may secure the necessary data and cooperate with authorized authorities. This does not mean constantly monitoring all private messages.
- Where possible, the User will be informed about the basis for significant restrictions on the account or Content. Information may be restricted when it is prohibited by law, required by security or procedural protection, or would facilitate the circumvention of security measures.
8. Reporting violations and appeals
- Content or behavior violating the law or the Regulations can be reported using the "Report violation" button available next to the Content, the reporting form, the website Report or messages to the address info@mkontakt.com.
- The report should include: the exact address or ID of the Content, a description of the violation and its justification, and, if possible, the User's ID, date of the event, confirming materials and contact details of the reporting person. The report must be submitted in good faith.
- The operator analyzes notifications without undue delay. Reporting itself does not constitute an infringement; before making a decision, the available context and credibility of the information are assessed.
- A person whose Content has been removed or whose account has been restricted may request a reconsideration of the decision via the contact form or e-mail. The appeal should indicate the account, the decision and the reasons why the User believes it was wrong.
- Abuse of the reporting system, in particular consciously submitting obviously unfounded reports in order to harm another person, may itself be considered a violation of the Regulations.
- Reporting an immediate threat to life, violence or an ongoing crime does not replace contacting the emergency number 112 or the competent authorities.
9. Paid services
- If a given function is paid, its price, scope, operating time and payment method are presented before placing the order. Failure to purchase an additional service does not result in a fee for simply having an account.
- Payments may be processed by external payment operators on the terms indicated during the purchase. The User should not provide payment data to other Users.
- The consumer's rights arising from mandatory provisions, including those regarding digital services and content, remain unaffected. Payment complaints may be submitted in accordance with section 13.
- Blocking an account due to a culpable violation of the law or the Regulations does not automatically create the right to a refund of the service used. This does not limit the consumer's rights under the Act.
10. Data privacy and security
- The principles of personal data processing, legal bases, storage periods and the rights of people are described in Privacy policy.
- The Operator applies technical and organizational measures appropriate to the risk for data protection and business continuity. However, no online system is completely risk-free.
- You should exercise caution before meeting someone you meet online, do not send money to strangers, do not share passwords, login codes, document details or financial information.
- Commercial information is only sent if there is an appropriate legal basis. Acceptance of the Regulations does not automatically constitute consent to electronic marketing.
11. Responsibility
- The User is responsible for his/her own actions and Content as well as for damage resulting from culpable violation of the law, the Regulations or the rights of third parties.
- The Operator is not a party to any relationships or meetings between Users and does not guarantee the accuracy of any information provided in the profile. The Operator responds to credible reports and takes actions provided for by law and the Regulations.
- The Operator is liable for non-performance or improper performance of its obligations under the principles arising from applicable regulations. Nothing in the Regulations excludes consumer rights or liability that cannot be excluded by law.
- The Operator is not liable for interruptions or damages resulting solely from force majeure, the User's action, failure on the part of the Internet provider or unlawful action of a third party, if they could not be prevented despite exercising due diligence.
12. Termination of use of the Website
- The user may terminate the contract and delete the account at any time using the function available in the profile settings. If he cannot access his account, he should contact the Operator.
- The Operator may terminate the provision of services in the event of permanent cessation of operation of the Website, serious or repeated violation of the Regulations, illegal use of the account or bypassing a previous block.
- An account that is inactive for at least 180 days may be deleted if this is consistent with the current retention policy and applicable law. If possible, the User will be informed in advance to the saved e-mail address.
- After deleting the account, some data may be stored for the period required by law, needed for settlements, defense of claims, security or restoration of data from backup copies, in accordance with the Privacy Policy.
13. Complaints
- A complaint regarding the operation of the Website, account or paid service may be submitted via the website Contact or to the address info@mkontakt.com.
- The complaint should include data identifying the account or transaction, a description of the problem, the date of its occurrence, the expected solution and the address for response. You should not send your password.
- Complaints are considered without undue delay, generally within 14 days of receiving a complete notification. If the matter requires completion, the deadline runs from the receipt of the necessary information.
- The complaint procedure does not limit the consumer's rights to use the court or extrajudicial means of resolving disputes provided for by law.
14. Changes to the Regulations
- The Regulations may be changed for an important reason, in particular as a result of a change in the law, scope of services, technology, security rules, moderation methods, payment terms or the need to counteract new abuses.
- Information about a significant change will be made available on the Website, and if required by regulations or the nature of the change - also provided to the User in advance on a durable medium or saved e-mail address.
- Urgent changes that are necessary to enforce the law or remove an immediate threat to safety may enter into force without the standard notice. The reason for such a change will be explained to the extent possible.
- If the User does not accept the amended Regulations, he or she may terminate the use of the Website and delete the account before the changes enter into force. This does not violate acquired rights or rights arising from consumer law.
15. Final provisions
- Polish law applies to the contract, subject to the mandatory rights of the consumer arising from the law of the country of his habitual residence.
- If any provision of the Regulations turns out to be invalid, the remaining provisions shall remain in force, provided that the applicable law allows the contract to be maintained in the remaining scope.
- The Regulations should be interpreted in a manner consistent with applicable law, in particular with the provisions on the provision of electronic services, consumer protection, personal data protection and digital services.
- In matters not regulated by the Regulations, applicable legal provisions shall apply.
